Would refinancing my mortgage affect my title or current title insurance?
Question by Mark: Would refinancing my mortgage affect my title or current title insurance?
I’d like to take advantage of the low interest rates but, unfortunately, I’m also involved in litigation with a neighbor where I’m represented by my title insurer. Would refinancing my mortgage now disrupt that coverage in any way?

Not if you are working under an owner’s title policy; just changes the policyholder for the lender’s policy.
Give your answer to this question below!
If you are involved in a legal matter and the property is involved, then you would not be in a position to refinance.
Lenders would only lend on property that is not in litigation and have a clean title.
I hope this has been of some benefit to you, good luck.
“FIGHT ON”
As loanmaster indicated, you will not be able to refinance until the legal situation is cleared up with your neighbor. To refinance, you would need a new title insurance policy, and no title insurer will issue you a policy as long as this litigation remains open.
